The new BS7858 2019 vetting standard will replace the existing BS7858 2012 standard as of 31/03/2020. All employers will require a copy of the new standard and should refer to it in full. Some changes may be required to internal processes and application processes.
The new standard places the responsibility of completing BS7858 Screening on the Top Management within the business.
It also states a risk based approach should be used when recruiting to ensure all new employees are suitable to be employed in a secure environment and employers should not just rely on the BS7858 screening.
It also states when outsourcing that the employer retains ultimate responsibility. We would suggest a sign off sheet that easily shows the completed screening file has been signed off as complete.
All data requested and provided by the applicant is subject to GDPR and full rights should be given and all relevant consents provided before any screening commences.
The standard also states that an offer of conditional employment should not be made until:

The use of a Statutory Declaration requires sign off from an authorised person.
If vetting cannot be completed the individual should not continue in employment with the organisation.
The allowed vetting period may be extended to a maximum of four weeks. It must be shown that all written requests for references and information have been made.
All extensions must be signed off by an authorized person.
The requirement for character references has now been dropped as these are open to abuse.
Where direct referencing is not possible the standard states the below documents should be requested.
The standard now includes the use of documents to cover “Career Breaks” such as non-registered carer or stay at home parent. The documents requested must be relevant to the period.
